• De acuerdo con la iniciativa presentada por integrantes del PAN, las penas aumentarían en dos terceras partes cuando el delito sea cometido contra una mujer.
Con el objeto de tipificar como delito las agresiones hechas con sustancias químicas e incrementar las sanciones por este ilícito, la diputada Verónica Pulido Herrera, en coautoría con los diputados Jaime Enrique de la Garza Martínez, Miguel David Hermida Copado y Enrique Cambranis Torres, presentó la iniciativa de decreto que adiciona un artículo 137 bis al Código Penal del estado.
De acuerdo con la propuesta, se impondrían de siete a trece años de prisión y multa de 300 a 700 veces el valor diario de la Unidad de Medida y Actualización (UMA), a quien por sí o por interpósita persona, cause a otra lesiones, usando para ello cualquier tipo de agente o sustancia corrosiva, cáustica, irritante, tóxica o inflamable, álcalis, ácidos y sustancias similares.
Incluyendo las que necesiten de otro agente para reaccionar, provocando un daño o enfermedad incurable; la inutilización completa o la pérdida de una extremidad u órgano; cuando quede perjudicada cualquier función orgánica o se genere alguna discapacidad o deformidad incorregible en la piel.
La pena prevista en el presente artículo se aumentará en dos terceras partes, cuando la víctima sea una mujer.
En su intervención durante la décima primera sesión, la diputada Pulido Herrera subrayó que como legisladoras y legisladores tienen el deber de mantener actualizado el orden jurídico para que esté en sintonía con la realidad que vive la población y, en casos específicos, para prevenir atender y sancionar el tipo de violencia que padecen las mujeres.
Agregó que aunado a los casos de violencia ya contemplados en el marco penal, se presentan los cometidos por medio de agentes o sustancias químicas corrosivas, como gasolina, cloro, ácido sulfúrico, entre otros que, en una fusión, pueden provocar lesiones permanentes sobre la salud de las mujeres, “por lo que, estas conductas delictivas deben ser sancionadas por el Estado con un castigo ejemplar”.
Previamente, refirió que los ataques con ácido causan daño de manera inmediata, provocando desfiguración, dolor y complicaciones médicas duraderas para las víctimas. Las quemaduras por ácido requieren, en la mayoría de los casos, cirugías significativas, así como apoyo y rehabilitación a largo plazo.
A la iniciativa se adhirió el grupo legislativo de Morena; las diputadas Nora Jéssica Lagunes Jáuregui, Ruth Callejas Roldán, Arianna Guadalupe Ángeles Aguirre, Citlali Medellín Careaga, Maribel Ramírez Topete, Tanía María Cruz Mejía, Itzel Yescas Valdivia y Anilú Ingram Vallines, así como los diputados Othón Hernández Candanedo, José Luis Tehuintle Xocua y Juan Enrique Santos Mendoza. Para su estudio y dictamen fue turnada a la Comisión Permanente de Justicia y Puntos Constitucionales.
